To help you understand how these laws actually work in practice, the following are short scenarios [7] regarding discrimination against each of the federally protected classes of persons.
Race: Ray is an African American and Sonia an Asian American. Both work in sales and are frustrated with the territories they have been assigned. But the employer explains that, to maximize sales, the company has assigned them to areas with high percentages of black and Asian residents.
Color: Melanie works at a large department store and applied for promotion from sales clerk to manager of the beauty products counter. But she was turned down because Melanie is a brown-complexioned Latina and, according to her boss, the store’s major vendor for beauty products prefers a “light-skinned” representative.
Religion: Yusef, a new employee, arrived ten minutes late for work after attending services at his local mosque. Though his supervisor knew the reason, she still disciplined him. Yet Joanne, a longtime employee, has long been allowed to arrive ten to fifteen minutes late on days that she attends mass at her Catholic church.
Sex: Charlene and Herb are tennis instructors at the same health club and make about the same pay. But while Charlene is paid by the lesson, Herb receives a guaranteed weekly salary. Though their earnings are similar, they are not being paid in the same form for substantially equal work.
National origin: Suhail is of Arab descent and employed by a software development firm. He notices that coworkers who get the best projects and fastest promotions have strong relationships with company supervisors developed through off-hours socializing. But Suhail receives invitations to these outings secondhand and at the last minute from coworkers, rather than directly from supervisors. His relationships have suffered, and he has been passed over for several projects. Suhail is concerned that his Arab descent has excluded him from the company’s informal social network.
Age: Barbara is age fifty-one and dismayed when her new employer says she cannot participate in the company’s pension plan. It excludes those who are hired within five years of the plan’s normal retirement age, which is fifty-five. Barbara files an age-discrimination complaint; because the normal retirement is age based, so is the exclusion.
Disability: Carl has applied for a company transfer to a higher-paying job in data entry. Because he is blind, however, the employer simply assumed he cannot effectively use a computer and did not put him on the list of candidates to be interviewed.
Genetic information: After Julie told her boss that her mother and father both died of cancer, the boss transfers Julie from the research lab—though she was an excellent researcher—to other nonresearch duties, which are supposedly “safer” but also have less career potential.
Complainant: Bill formally complained to his company’s human-resources office and to a city agency that his supervisor treats male employees less favorably than female coworkers. Soon afterward, Bill is fired because he is “not a team player.” When another employee gives testimony to a city investigator, that employee’s hours are cut.
